2. It does not matter if the defendant enters a plea of guilty. Although this was expressly ruled by the CSD in a decision of 25 July 1990, it cannot be upheld. It is not clear in the form that has been transmitted to us whether the defendant was indeed in the courtroom at the time of the statement's publication. Therefore, the decision of the CSD cannot stand. However, the Basic Law does not require that a criminal must be in the courtroom when statements or images are made. 3. The basic right of free opinion also applies to the issue of whether an express opinion on a public person's honour is in fact an expression of opinion. Its connection to personal honour is so intimate that the Basic Law implies its protection as a component of the freedom of opinion. In this connection, the Basic Law provides that the freedom of opinion is limited by considerations of public order.
